These Terms of Service govern your access to and use of RateGap.

RateGap is owned and operated by Cherry Capital Consulting LLC (“Company,” “we,” “us,” or “our”). By accessing or using RateGap, creating an account, or purchasing a paid plan, you agree to these Terms.

1. What RateGap Is

RateGap is an informational comparison tool that helps users compare different methods of converting U.S. dollars into Argentine pesos or receiving value through related payout methods. The platform may display estimated fees, exchange rates, rankings, alerts, tracking features, guides, and related content. The site currently offers a free comparison experience and additional Pro features such as email alerts, method tracking, relevant-change notifications, and weekly email summaries.

2. Informational Use Only

RateGap is provided for informational and educational purposes only.

RateGap is not a bank, money transmitter, exchange house, broker, financial advisor, tax advisor, or legal advisor. Nothing on the platform constitutes financial, investment, legal, accounting, or tax advice.

You are solely responsible for verifying final fees, exchange rates, payout availability, transfer restrictions, and legal or tax consequences before acting on any information shown through RateGap.

3. Estimates and Accuracy

RateGap uses calculations, platform data, user inputs, configured values, and other available information to generate comparisons and estimates. The site itself states that values are estimates and may vary.

We do not guarantee that any comparison, result, rate, fee, ranking, estimate, or alert is complete, current, accurate, or suitable for your specific situation. Real-world provider fees, spreads, exchange rates, timing, payout limits, and availability may change without notice and may differ from the values shown on RateGap.

4. Accounts

To access certain features, you may be required to create an account. You agree to:

• provide accurate and current information;
• keep your login credentials secure;
• use your account only for lawful purposes;
• notify us promptly of any unauthorized access or suspected breach.

You are responsible for all activity that occurs under your account.

5. Free and Paid Features

RateGap may offer free features and paid subscription features. The site offers a free tier and a Pro offering with premium email alerts and tracking functionality.

We may change, add, remove, limit, or discontinue features, plans, or pricing at any time, subject to applicable law.

6. Billing, Renewals, and Payments

If you subscribe to a paid plan:

• you agree to pay all fees shown at checkout;
• payments may be processed by a third-party payment provider, including Stripe, as stated on the site;
• subscriptions may renew automatically unless canceled before the next billing date;
• taxes may apply where required;
• promotional pricing, referral benefits, or discounts may be subject to separate conditions.

Unless required by law, paid fees are non-refundable once billed.

7. Referrals and Promotions

RateGap may offer referral credits, discounts, promo codes, or similar incentives. The site currently references referral-based credits and special pricing for referred users.

We may modify, suspend, or terminate referral or promotional programs at any time. We may withhold credits or benefits in cases of abuse, fraud, self-referrals, manipulation, or violation of these Terms.

8. Acceptable Use

You agree not to:

• use RateGap for unlawful, misleading, or fraudulent purposes;
• interfere with the platform or its security;
• scrape, copy, reverse engineer, or automate access to the service except as allowed by law;
• attempt to bypass account, payment, or feature restrictions;
• upload or transmit malicious code;
• use the service in a way that could damage, disable, or overburden the platform.

9. Guides, Content, and Third-Party Links

RateGap may publish guides, educational content, and links to third-party services or platforms. The site currently includes guides and notes that some links may be referral links, while stating that referral status does not affect the comparator results.

We are not responsible for third-party websites, products, services, pricing, policies, or availability. Your use of third-party services is governed by their own terms and policies.

10. User Data and Inputs

You may provide inputs such as email address, comparison amounts, fee assumptions, alert settings, tracking preferences, and other account-related data. You represent that you have the right to provide any information you submit and that it is accurate to the best of your knowledge.

11. Intellectual Property

RateGap, including its software, design, text, graphics, branding, calculations, site structure, and original content, is owned by Cherry Capital Consulting LLC or its licensors and is protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, revocable, non-transferable license to access and use RateGap for your personal or internal business use.

12. Termination

We may suspend or terminate your access to RateGap at any time, with or without notice, if we believe you violated these Terms, created risk for the platform, or used the service in a harmful or unlawful way.

You may stop using the service at any time. If you wish to cancel a paid subscription, you must do so before your next renewal date.

13. Disclaimers

RATEGAP IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

We do not warrant that the service will be uninterrupted, error-free, or free of delays, omissions, or inaccuracies.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHERRY CAPITAL CONSULTING LLC AND ITS AFFILIATES, OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR FINANCIAL LOSS ARISING OUT OF OR RELATED TO YOUR USE OF RATEGAP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO RATEGAP WILL NOT EXCEED THE GREATER OF: THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $50.

15. Indemnification

You agree to defend, indemnify, and hold harmless Cherry Capital Consulting LLC and its affiliates, officers, members, employees, contractors, and service providers from claims, damages, losses, and expenses arising out of your misuse of RateGap, your violation of these Terms, or your violation of any law or third-party right.

16. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

Any dispute arising from these Terms or your use of RateGap shall be brought exclusively in the state or federal courts located in Grand Traverse County, Michigan, and you consent to those courts’ jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated version and update the Effective Date. Your continued use of RateGap after the revised Terms become effective means you accept them.
